1. Who Controls Your Information

2. Information We Collect
Information You Provide
- Identity and contact information, such as your name, email address, telephone number, billing address, and shipping address.
- Account information, login credentials, preferences, and communications with Customer Support.
- Order information, including products, customization selections, price, shipping choice, order status, and refund history.
- Customization materials, including photographs, facial images, names, text, design instructions, uploaded artwork, design previews, CAD files, and 3D models.
- Rights and authorization evidence submitted for intellectual-property or portrait-rights review.
Payment Information
Payment providers process payment credentials and may collect identity, billing, device, and fraud-prevention information under their own privacy notices. SparkU ordinarily receives transaction identifiers, payment status, amount, currency, payer contact information, billing details, and limited risk or dispute information, but does not ordinarily store your complete card number.
Information Collected Automatically
We may collect IP address, browser type, device information, timestamps, pages viewed, session information, error logs, security events, and essential cookie identifiers needed to operate accounts, carts, checkout, security, and language or session preferences.
3. How We Use Information
- Provide accounts, customer support, order processing, design previews, 3D modeling, manufacturing, shipping, returns, refunds, and dispute handling.
- Review uploaded content for production feasibility, safety, fraud, and intellectual-property or privacy risks.
- Verify transactions, prevent account abuse, investigate fraud, secure the website, and comply with payment-network requirements.
- Maintain tax, accounting, customs, compliance, and transaction records.
- Send transactional messages about accounts, designs, orders, production, shipping, refunds, policy changes, and security.
- Send marketing communications where permitted by applicable law and provide an unsubscribe method in each marketing email.
- Improve reliability, customer service, production workflows, and product quality using aggregated or de-identified information where reasonably possible.
4. Photographs, Facial Images, and AI Processing
We use uploaded photographs, facial images, and design files to generate design previews, create 3D models, manufacture products, provide customer support and after-sales service, and review content for safety and rights compliance.
We do not use customer photographs or designs to train a general-purpose AI model by default. If we later offer an optional training or improvement program involving identifiable customer content, we will request separate, affirmative consent and explain the scope before use.
We do not use facial images to identify you, authenticate you, or create a biometric identification profile. If a future feature involves biometric identification, we will provide a separate notice and obtain any consent required by law before enabling it.
5. Legal Bases Where Required
Where applicable law requires a legal basis, we process information as necessary to perform a contract with you, take steps at your request before entering a contract, comply with legal obligations, protect legitimate interests such as security and fraud prevention, or based on consent. You may withdraw consent for future processing where consent is the applicable basis, without affecting processing already completed.
6. How We Share Information
We share only the information reasonably necessary for the relevant service with:
- Payment processors, acquiring banks, wallets, fraud-prevention providers, and payment networks.
- AI-model and design-processing providers used to create previews or models.
- Cloud hosting, storage, email, account, analytics, and customer-support providers.
- Authorized designers, manufacturers, quality-control providers, and packaging partners.
- Carriers, customs agents, and fulfillment providers.
- Professional advisers, insurers, auditors, regulators, courts, or law-enforcement authorities where reasonably necessary or legally required.
- A buyer or successor in a merger, financing, reorganization, or sale, subject to appropriate confidentiality and legal requirements.
We do not sell personal information for money. As of the Effective Date, we use only essential cookies and do not use third-party advertising pixels listed in our information confirmation. If this changes, we will update this Policy and provide any legally required choices.
7. International Processing
Our primary online systems store and process data in the United States. Because SparkU is operated by a company in China and coordinates design, manufacturing, and support, authorized personnel and service providers in China may access or process information needed to fulfill orders. Payment, cloud, logistics, and support providers may process information in additional countries.
Where required, we use contractual, organizational, and technical safeguards intended to protect information transferred across borders. Local laws in a destination country may differ from those in your place of residence.
8. Retention
- Customization files not connected to a completed order are generally deleted or de-identified within 30 days, unless you ask us to retain them or another lawful reason applies.
- Photographs, design files, CAD files, and 3D files connected to an order are generally deleted or de-identified within 30 days after order completion.
- After-sales files are generally retained for 30 days after the support matter is resolved.
- Order, payment, tax, customs, fraud-prevention, consent, complaint, and legal records may be retained longer where reasonably necessary for legal, accounting, security, dispute, or compliance purposes.
9. Cookies
We use essential cookies and similar technologies to keep the website functioning, maintain sessions and carts, remember basic preferences, enable checkout, detect fraud, and protect accounts. Blocking essential cookies may prevent parts of the website from working. If we introduce non-essential analytics or advertising cookies, we will update this Policy and provide any consent or opt-out mechanism required by law.
10. Marketing and Transactional Messages
We send transactional messages needed to provide your account and orders. We may send marketing messages after a purchase only where permitted by applicable law. You can unsubscribe using the link in a marketing email or by contacting us. Unsubscribing from marketing does not stop necessary order, security, policy, or service communications.

We will respond within the period required by applicable law.
12. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information. No system is completely secure. You are responsible for protecting your password and notifying us promptly if you suspect unauthorized access.
13. Children
Our services are intended for adults aged 18 or older. We do not knowingly allow a minor to create an account or place an order. An adult who submits a minor's image must have the authority and guardian permission necessary for the customization. Contact us if you believe a minor provided information without appropriate authorization.
14. Changes to This Policy
We may update this Policy for legal, operational, security, or service changes. For a material change, we will post a prominent website notice and email registered users where appropriate at least seven days before the change takes effect, unless an earlier change is required for legal or security reasons.
